  • INTRODUCTORY PROVISIONS

Article 1.

These are the general terms and conditions (hereinafter: “General Terms“) of the trading company KIDDIE ON BOARD d.o.o., Kaštel Novi, Ulica Nikole Zrinskoga 7, represented by director Nikolina Čapalija.

 

Article 2.

The term Service Provider refers to the trading company KIDDIE ON BOARD d.o.o. for services.

The term User refers to a natural person who, as a consumer, enters into a legal transaction with the Service Provider outside of his trade, business, craft or professional activity in accordance with the provisions of the Consumer Protection Act (Official Gazette No. 19/2022, 59/2023 hereinafter: “ZZP“) and also refers to legal entities to which the provisions of the ZZP do not apply. Natural person users can only be adults.

The term product refers to a specific item from the Service Provider’s assortment that, based on the rental agreement and these General Terms and Conditions, is handed over to the User for use for a certain period of time, for which the User undertakes to pay a certain rent to the Service Provider.

 

Article 3.

Users are instructed to familiarize themselves with the General Terms and Conditions before concluding a rental agreement and to check them regularly, in order to be familiar with all their rights and obligations.

These General Terms and Conditions apply to all current and future business relationships, i.e. to any rental of products from the Service Provider’s range concluded during the period of validity of the General Terms and Conditions, in which the Service Provider hands over a certain item from its range to the User for use, and the latter undertakes to pay for it the agreed rent, so that all offers and deliveries of products are executed exclusively on their basis, unless otherwise expressly agreed in writing. Exceptionally, the application of the General Terms and Conditions to an individual contractual relationship can be excluded in writing, or the individual provisions of the General Terms and Conditions.

The general conditions form an integral part of every contract with the User and complement it. In the event that the provisions of the individual written contract deviate from the provisions of the General Terms and Conditions, the provisions of the individual written contract take precedence. The validity of any previous oral agreements is excluded. In the event that the User has general business conditions that deviate from these General Terms and Conditions, the contracting parties mutually agree to the application of these General Terms and Conditions, unless otherwise agreed.

The Service Provider reserves the right to change the General Terms and Conditions, the scope and content of the services as well as the appearance and functionality of the web pages and other data related to the website at any time without prior notice, provided that any changes to the General Terms and Conditions apply exclusively to contracts concluded after their entry into force of the amended General Terms and their publication on the website of the Service Provider conditions may be deviated from.

 

Article 4.

These General Terms and Conditions also represent a pre-contractual notice and refer to the conclusion of a rental agreement if the User is a consumer, i.e. any natural person who enters into a legal transaction or operates on the market outside of his trade, business, craft or professional activity, and if the consumer concludes a contract outside business premises of the Service Provider, i.e. distance contract.

These General Terms and Conditions also apply to the rental agreement and apply to legal entities as well as natural persons acting in the scope of their trade, business, craft or professional activity, with the exceptions stated in these General Terms and Conditions.

 

Article 5.

These General Terms and Conditions will be published on the website of the Service Provider: www.kiddieonboard.hr

Access to the Service Provider’s website may sometimes be unavailable due to maintenance or the introduction of new content, and in cases of unforeseen circumstances beyond the Service Provider’s control, which the Service Provider will try to remedy as soon as possible.

 

  1. SUBJECT OF THE SALE

Article 6.

The Service Provider is a trading company specializing primarily in the provision of rental and leasing of items for personal and household use. The subject of the lease will be described on the Service Provider’s website or will be determined in some other way in writing, and the subject of the lease can only be changed by written agreement.

 

Article 7.

The subject of the order can only be products for which it is indicated in the order that they are available. Due to the large number of orders that are submitted simultaneously on the Service Provider’s website, it may happen that the information about the availability of the products is not the same as the state in the warehouse, therefore the Service Provider does not guarantee the availability of the ordered products until it confirms the order

If the ordered product is not available in the warehouse or available in another way, the Service Provider can inform the User that: (i) the product is currently not available, (ii) about the deadline in which the product will be available, (iii) agree on a new delivery deadline if necessary, and (iv) at the same time offer the possibility of renting an alternative product that is available for delivery and that is closest in terms of its characteristics to the product that cannot be delivered.

 

Article 8.

Photos of products from the Service Provider’s range on the website are illustrative in nature, and do not always have to correspond in all details to the products that are the subject of the order (e.g. color). The visual identity of the product shown in the photo does not have to correspond to the appearance of the product in reality, and with regard to the monitor settings on the User’s computer, etc. In the case of the above-mentioned discrepancy between the product shown in the photo and the delivered product, it is not considered a product defect.

Product information (product and/or service description, price, etc.) displayed on the Service Provider’s website is subject to “bugs”, irregularities in the operation of the app and/or website, other technical irregularities, typographical errors, etc. In case of obvious errors or inaccuracies with regard to product data displayed on the Service Provider’s website, the same reserves the right to unilaterally terminate the contract.

 

  1. ESTABLISHMENT OF CONTRACTUAL RELATIONSHIP

Article 9.

The contractual relationship between the Service Provider and the User is established upon acceptance of the offer (regardless of whether the parties concluded the contract in writing or whether the business cooperation is based on the offer and purchase order or in another written way), regardless of when the product is handed over to the User.

The User accepts the application of these General Terms and Conditions and agrees that they shall be primarily authoritative for the interpretation of the will of the contracting parties. In the event of any inconsistency between the written offer and the General Terms and Conditions, the General Terms and Conditions shall prevail, unless otherwise agreed in writing.

 

Article 10.

The Service Provider’s non-binding offers are considered an invitation to the User to submit an order to the Service Provider (rental offer) under these conditions. Only when the Service Provider accepts / confirms such an order of the User in writing, the obligation for the Service Provider arises.

 

Article 11.

Unless otherwise expressly agreed in writing, the User (who has the status of a consumer in the sense of the Consumer Protection Act – hereinafter: ZZP) with the order / offer sent to the Service Provider expressly declares the request that the performance of the contracted service (for which the consumer contractually assumes the obligation to pay) begins before expiration of the term for unilateral termination of the contract from Article 79 of the ZZP.

The User confirms that he is aware that he loses the right to unilateral terminate the contract from Article 79 of the ZZP if the service is fulfilled in full and that in case of unilateral termination of the contract, he will be obliged to pay the Service Provider a reasonable part of the price in accordance with Article 84 paragraph 8 of the ZZP.

 

  1. PRICES AND PAYMENT

Article 12.

The Service Provider regulates the price of the rental of products from its assortment with a special price list that is subject to change, and which can be highlighted in offers, price lists, the website and other materials. The prices are expressed in euros, and represent the net price increased by the cost of VAT in the amount of 25% at the rate prescribed by the Value Added Tax Act (Official Gazette No. 3/2013 etc.) at the time of product delivery. The price does not include incidental costs (delivery costs, packaging, etc.) which are charged separately to the User and which may be highlighted in offers, price lists, the website and other materials.

 

Article 13.

Upon acceptance of the offer, the Service Provider places a reservation on the product that is the subject of the contract, and the total rental fee is due and payable immediately upon the completed order.

 

Method of payment:

The Service Provider enables following payment methods:

  • Card payment: 
  • In up to 24 installments: Visa Premium credit card up to 24 installments without interest
  • One-time: Visa Premium, Visa, MasterCard
  • By general payment or Internet banking (when choosing this method of payment, the User will receive an invoice to the e-mail address with the information necessary for the payment. Upon receipt of the payment, the Service Provider will send the ordered products to the User.)



Article 14.

In case of late payment, the Service Provider will charge the User late interest in accordance with the applicable legal regulations.

 

  1. DELIVERY AND COLLECTION OF PRODUCTS

Article 15.

The Service Provider enables product delivery through:

– Collection of products in the warehouse of the Service Provider company,

– Delivery to the User’s address,

– Delivery to Split Airport.

 

Article 16.

In the case of choosing to personally pick up the product from the warehouse, the User is obliged to pick up the product from the warehouse within the agreed time period. If the User does collect the product within the agreed time period, he is obliged to pay the rent from the agreed term – the beginning of the lease, regardless of the aforementioned.

 

Article 17.

The Service Provider reserves the right to determine the method of transportation and the carrier used for product delivery. Delivery may be carried out by a courier service or transport company engaged in the provision of transport services, or personally by an authorized representative of the Service Provider.

Delivery of products to the User’s address is available throughout the country. For Split and its surrounding area, next-day delivery is available every day of the week. For locations more than 30 km from the company’s headquarters, orders must be placed at least four (4) working days in advance (exceptions may be made upon prior agreement), and delivery is only available Monday through Friday. Delivery is made to the entrance of the building at the delivery address. If the address is within a residential building, the delivery personnel are not obligated to carry the product to the floor where the User is located but only to the building entrance.

Express delivery with a shorter delivery time than specified above is exceptionally possible and is subject to an additional fee of EUR 8.00.

 

In the event that delivery is not possible within the agreed time due to force majeure or other disturbances beyond the control of the Service Provider, the User will be informed about this in a timely manner. In this case, delivery deadlines are automatically extended for the duration of force majeure events or other disturbances beyond the control of the Service Provider.

In case the User chooses delivery to his home address, specific and detailed information about the delivery will be sent to their e-mail address specified during the order.

The cost of delivery is determined by the price list. Delivery costs are paid in full by the User.

 

Article 18.

In the case of personal delivery (collection at the warehouse or delivery by an authorized person of the Service Provider), the product can be delivered without packaging, with only Instructions, or with packaging consisting of a waterproof plastic bag or pouch in which, in addition to the product, there are also Instructions for use for each individual product; and in the case of delivery by a delivery service, a cardboard box as well.

 

Article 19.

The User is obliged to collect the product from the delivery service.

In the event that the delivery of the product to the User’s address is not realized due to reasons on the part of the User (incorrect data entry concerning: e-mail address, contact number, collection address, etc.) or if the User does not accept delivery of the sent products without a valid reason, and they are returned to the Service Provider (e.g. with the indication “notified did not pick up”), the Service Provider will re-send the product for delivery to the User.

In the case referred to in paragraph 2 of this article, the Service Provider reserves the right to charge additional shipping costs incurred by the User.

If the User does not take over the product within the agreed period, he is obliged to pay the rent from the day when the delivery was not realized due to reasons on the User’s side, regardless of the aforementioned.

 

Transfer of risk and liability for material defects

 

Article 20.

All risks related to products and delivery pass to the User at the moment of handing over the product to the User.

 

Article 21.

The User is obliged to notify the Service Provider in writing of any missing product quantities or wrongly delivered product without delay, and no later than within 24 hours from the day of receipt of the product delivered by the delivery service, with accurate information about the missing quantity or wrongly delivered product the product and the photograph of defects/unsuitability, otherwise User loses the right that belongs to him on that basis.

If the product is picked up at the Service Provider’s warehouse or is delivered by an authorized representative of the Service Provider, the User is obliged to inspect the product on the spot.

 

Article 22.

The User who does not have the status of a consumer is obliged to inspect the received product in the usual way immediately upon taking it over or to give it for inspection, as soon as possible according to the regular course of things, and to notify the Service Provider of visible defects without delay, otherwise he loses the right that belongs to him on that basis.

 

  1. GENERAL RENTAL PROVISIONS

Article 23.

The Service Provider undertakes to deliver / make available correct, clean and disinfected products.

The User is obliged to handle the rented products with the attention of a good businessman and in accordance with the instructions for use made available by the Service Provider, and is to be responsible for the damage caused by the loss, damage and/or theft/disappearance of the rented products.

The User is not authorized to use the products contrary to their intended purpose. During the use of the product, the User must ensure that the product is not used in inadequate conditions. The User may not make any modifications, repairs or any other operations on the rented products.

The User is not authorized to sublease the rented products to third parties without the prior written consent of the Service Provider.

The User is responsible for all damages caused to the products due to non-compliance with the above conditions.

 

Duration of rental, product return, liability for damage and collection of damage.

Article 24.

The rental begins on the day when the User collects the product (in person or through an authorized person) in the warehouse or when the product is collected (in person or through an authorized person) by the delivery service or the Service Provider, and ends on the day of return to the same warehouse or the day the product is handed over to the delivery service or person authorized by the Service Provider. The agreed duration of the lease can be extended only expressly with the prior consent of the Service Provider with the obligation that the User has previously informed him in writing no later than 2 days before the end of the lease.

Exceptionally from paragraph 1 of this article, the rental begins on the day it is contracted and the product is not taken over by the User due to his fault.

 

Article 25.

The User can freely choose the way of returning the rented products. The User can return the rented products:

  1. By handing it over to the Service Provider’s warehouse (in person or through an authorized person),
  2. By delivery via a delivery service,
  3. By handing over directly to an authorized person to the Service Provider at the User’s address or any location previously agreed

 

Article 26.

In the case of returning the product by direct delivery to the Service Provider’s warehouse or by handing it over to an authorized person of the Service Provider at the User’s address, the product must be delivered by 8:00 p.m. on the last day of the rental, and in the case of returning the product through the delivery service, the product must be delivered to the delivery service at the time when the delivery service announces their arrival on the last day of the rental period.

The User is obliged to propose to the Service Provider a change in the method of returning the product no later than 9:00 a.m. the previous day.

 

Article 27.

The User is obliged to return the rented products in their original condition, fully operational, clean and without damage beyond regular use. The products are returned in the same packaging in which they were delivered, except in the case that due to the nature of things this would not be possible, therefore the User is recommended to save the packaging in which he received the ordered products.

 

Article 28.

After returning the product, the Service Provider will inspect it, define any possible damage, contamination, malfunctions and other defects and inform the User about them in writing without delay.

 

Article 29.

For all returned products that are damaged and/or soiled during the rental period either by the User or by a third person to whom the User handed over the rented product, the User is obliged to pay the Service Provider the full price of the repair and/or cleaning costs.

If the repair and/or cleaning is not possible or economically profitable (total damage), as a result of which the product is no longer suitable for use, the User is obliged to pay the difference between the rental price and the retail price of the product.

 

Article 30.

If the User does not return the rented product within 10 days from the expiration of the agreed return period, then the product will be considered lost/missing due to the User’s fault, and the Service Provider will be authorized to charge the User the retail price of the product in addition to the late payment.

The User accepts that the Service Provider is not responsible for omissions, errors, defects, damages, etc. that occur during, or by, the delivery services, which is why he waives claims against the Service Provider that are a consequence of said delivery service failures.

 

Late fee

Article 31.

If the User does not return the rented products within the agreed period, then the User is charged a late fee in the amount of the price per day of product rental for each day of delay increased by 50% of the agreed amount.

 

The right to cancel the contract

Article 32.

The contract concluded between the Service Provider and the User can be unilaterally canceled by the User, under which the following conditions apply:

  1. a) if the User’s cancellation is delivered up to 7 days before the agreed first day of the rental – the Service Provider returns the total amount of rent;
  2. b) if the User’s cancellation is delivered from the 7th to the 3rd day before the agreed first day of the rental – the Service Provider will refund 50% of the total rental amount;
  3. c) if the User’s cancellation is delivered within 3 days to the day of the agreed first day of the rental – there is no refund of the rent.

In case of cancellation from paragraph 1 of this article, the User has the right to refund the delivery costs, provided that the product has not been sent to the User for delivery by the time of cancellation.

The User’s unilateral cancellation from this article shall be sent in writing and by email to the Service Provider, using the information in the header of these Terms and Conditions.

 

  1. CONSUMER PROTECTION

Article 33.

The provisions of Articles 7 and 8 of the General Terms and Conditions (Articles 37 to 47) apply exclusively to contractual relationships arising from the conclusion of a rental agreement between the Service Provider and the User who has the capacity of a consumer, i.e. a natural person who, as a consumer, enters into a contract with the Service Provider legal business outside of their trade, business, craft or professional activity in accordance with the provisions of the ZZP.

The lease agreement concluded by the Service Provider and the User is considered in the context of ZZP a service contract, i.e. a contract by which the Service Provider provides or undertakes to provide a service to the consumer, and the consumer pays or undertakes to pay the Service Provider a price.

 

RIGHT TO UNILATERAL TERMINATION OF THE CONTRACT

Article 34.

The User – consumer has the right to unilaterally terminate the remote contract within fourteen days from the conclusion of the product rental agreement, i.e. to cancel the order made through the website, without giving any reason. The User – consumer has this right only in the cases stipulated by the ZZP. The term for unilateral termination of the contract starts from the day the contract is concluded.

A copy of the form on unilateral termination of the contract is as follows:

  1. Name, surname and address of the consumer ____________________
  2. To: here the merchant enters his name and headquarters, as well as his phone number, e-mail address or fax number
  3. I _____________________ hereby declare that I unilaterally terminate the Contract for the sale of the following products (select)_________________, ordered/received on ______________________

– the consumer’s signature (only if this form is filled out on paper),

Article 35.

In order for the User to be able to exercise the right to unilaterally terminate the contract, he must inform the Service Provider of his decision before the expiry of the deadline, by means of an unequivocal statement sent by mail or e-mail, in which he will state his name and surname, address, telephone number, or e-mail address, and can also use the attached sample form for unilateral termination of the contract.

 

Article 36.

The User – consumer does not have the right to unilaterally terminate the contract if the service contract for which the User as a consumer has undertaken the obligation to pay the price has been fully fulfilled, and the fulfillment has begun with the explicit prior consent of the User – consumer and with his confirmation that he is aware of the fact that lose the right to unilaterally terminate the contract if the service is fully fulfilled.

 

Article 37.

If the consumer exercises his right to unilaterally terminate the contract, the parties are not obliged to fulfill their obligations from the contract concluded outside the business premises and the contract concluded at a distance, and each party is obliged to return to the other what it received on the basis of the contract. The consumer is not obliged to compensate the costs that were a consequence of using his right to unilaterally terminate the contract, except for those provided for in Article 83, Paragraph 2 and Article 84 of the ZZP.

 

Article 38.

If the User unilaterally terminates the contract without receiving or taking over the ordered product, the Service Provider will refund the money, without delay, and no later than within 14 days from the date of receipt of the decision on unilateral termination of the contract. The refund will be made in the same way the User made the payment.

 

Article 39.

In the event that the User has unilaterally terminated the contract after receiving the product, then the Service Provider must refund the amount paid only after the product has been returned to him, i.e. after the consumer provides him with proof that he sent the product back.

In case of unilateral termination of the contract, the User is obliged to return the products to the Service Provider without undue delay.

The Service Provider is under no obligation to refund additional costs resulting from the consumer’s explicit choice of a type of transportation that is different from the cheapest type of standard transportation offered by the Service Provider.

During the period in which the User – consumer exercises the right to terminate the contract, he must keep the product with due care, that is, he must behave as a particularly careful and A conscious person. In the event of a decrease in the value of the product as a result of handling the product by the User, then the Service Provider has the right to charge damages from the amount of the received price in the proportion of the decrease in the value of the product according to its own assessment, taking into account the objective criteria of each individual case.

 

Article 40.

If the User-consumer unilaterally terminates the contract after having expressly requested that the provision of the service begin before the expiry of the term for unilateral termination of the contract, then the User- consumer is obliged to pay the Service Provider a part of the agreed price that is proportional to what the Service Provider has fulfilled to the User- consumer up to the time when it has informed the consumer that he is using his right to unilaterally terminate the contract, with the provision that the proportional amount of the price that the User – the consumer is obliged to pay is calculated on the basis of the total contracted price.

 

Article 41.

The consumer is responsible for any reduction in the value of the product resulting from the handling of the product, except for that which was necessary to determine the nature, characteristics and functionality of the product.

 

  1. NOTICE ON THE MANNER OF WRITTEN COMPLAINT BY THE CONSUMER

Article 42.

Any complaints and objections to the receipt or the service, the User is obliged to submit to the Service Provider no later than within 8 days from the provision of the service. If in this way the User does not challenge the provided service in a timely manner, it is considered that the User has no objection to the provided service and agrees with it.

 

Article 43.

All complaints in accordance with Article 10 of the ZZP, the consumer can send by mail to the address of the Service Provider: Ulica Nikole Zrinskoga 7, 21217 Kastel Novi, email address info@kiddieonboard.hr or in person at the business premises of the Service Provider at the address Ulica Nikole Zrinskoga 7, 21217 Kastel Novi.

 

Article 44.

In order for Service Provider to respond to a consumer’s written complaint that was not sent by e-mail, consumers are asked to provide accurate information about their first and last name and the address to which the response will be delivered. The Service Provider must legally provide a response to a consumer’s complaint in writing no later than 15 days from the date of receipt of the complaint.

  1. TERMINATION OF THE CONTRACT AND CANCELLATION OF THE CONTRACT

Article 45.

The rental agreement ends with the proper fulfillment of the obligations of the contracting parties.

 

Article 46.

The Service Provider may terminate the Rental Agreement in the event that the User violates the provisions of the concluded Agreement and/or the provisions of the General Terms and Conditions.

The contract is canceled in writing, either via email or by sending a registered postal letter to the User’s address. If the User refuses to receive the cancellation, it is considered that the cancellation was delivered on the day the cancellation was submitted to the post office.

In this case, the Service Provider has the right immediately and without any restrictions to take over the products that were rented from the User, or the User is obliged to hand them over / deliver them within 3 days from the receipt of the contract cancellation notice.

In any case, the User will have to pay the Service Provider the rent, and all other claims arising from the contract, as well as compensate the Service Provider for all transportation costs and other costs incurred.

 

Article 47.

If the User, even after a written warning from the Service Provider, uses the product contrary to the contract or its purpose, neglects its maintenance, damages the product, especially if it leaves the use of the product to a third party without authorization, the Service Provider can cancel the contract without observing the notice period.

 

FORCE MAJEURE AND CHANGED CIRCUMSTANCES

Article 48.

The contracting parties will be released from responsibility for partial or complete non-fulfillment of obligations under the Contract if the same is caused by circumstances beyond their control that arose after the conclusion of the contract, which could not have been foreseen at the time of the conclusion of the contract, nor could the contracting parties have prevented, avoided or removed them, such as fires, earthquakes, floods as well as strikes, wars or military operations.

If in that case one of the contractual parties has fulfilled its obligations, it can demand return according to the rules on the return of what was acquired without a basis.

Article 49.

If, due to extraordinary circumstances arising after the conclusion of the contract, which could not be foreseen at the time of the conclusion of the contract, the fulfillment of the obligation would become excessively difficult for the Service Provider or would cause him an excessively large loss, he may demand that the contract be amended or even terminated.

 

  1. INTELLECTUAL PROPERTY

Article 50.

The content of the website of the Service Provider’s Internet store is protected and the Service Provider has the sole right to use it. For any commercial use of the content on the Service Provider’s website, it is necessary to contact the Service Provider beforehand via e-mail info@kiddieonboard.hr

 

  1. TRANSITIONAL AND FINAL PROVISIONS

Article 51.

In the event of a dispute arising out of or in connection with the concluded contract, the parties will try to resolve it amicably. In the event that a peaceful resolution of the dispute is not reached, the parties agree on the jurisdiction of the court in Split, with the fact that the Service Provider can initiate proceedings before the court of general local jurisdiction for the User.

 

Article 52.

If any part of the General Terms and Conditions becomes invalid, illegal or unenforceable in any way, the rest of the agreement and the General Terms and Conditions will remain in effect.

 

Article 53.

The law of the Republic of Croatia is applicable to the contracts concluded by the Service Provider in the performance of its activities.

In the event of a difference between the Croatian and English versions of these Terms and Conditions, the Croatian version shall apply.

 

Article 54.

The general business conditions come into force on May 20, 2024 and will also be available on the website of the company KIDDIE ON BOARD d.o.o. which reads: www.kiddieonboard.hr

Ovosu opći uvjeti poslovanja (u daljnjem tekstu: „Opći uvjeti“) trgovačkog društva KIDDIE ON BOARD d.o.o., Kaštel Novi, Ulica Nikole Zrinskoga 7, zastupano po direktoru Nikolini Čapaliji.

Članak 2.

Pojam Pružatelj usluga odnosi se na trgovačko društvo KIDDIE ON BOARD d.o.o. za usluge.

Pojam Korisnik odnosi se na fizičku osobukoja kao potrošač s Pružateljem usluga sklapa pravni posao izvan svoje trgovačke, poslovne, obrtničke ili profesionalne djelatnosti u skladu s odredbama Zakona o zaštiti potrošača (Narodne novine broj: 19/2022, 59/2023 dalje u tekstu: „ZZP“) te se odnosi i na pravne osobe na koje se ne primjenjuju odredbe ZZP-a.Korisnici fizičke osobe mogu biti samo punoljetne osobe.

Pojam proizvod odnosi na određenu stvar iz asortimana Pružatelja usluga koja se temeljem ugovora o najmu i ovih Općih uvjeta predaje Korisniku na uporabu na određeno vrijeme za što se Korisnik obvezuje za to plaćati određenu najamninu Pružatelju usluga.

Članak 3.

Korisnici se upućuju da se prije sklapanja ugovora o najmus upoznaju s Općim uvjetima te da iste redovno provjeravaju, kako bi bili upoznati sa svim svojim pravima i obavezama.

 

Ovi Opći uvjeti se primjenjuju na sve trenutne i buduće poslovne odnose, odnosno na svakinajamproizvoda iz asortimanaPružatelja uslugazaključen u razdoblju važenja Općih uvjeta u kojima Pružatelj uslugapredaje određenu stvar iz svojeg asortimanakorisniku na uporabu, a ovaj mu se obvezuje za to plaćati ugovorenu najamninu, tako da se sve ponude i isporuke proizvoda izvršavaju isključivo na temelju njih, ukoliko se drukčije ne ugovori izričito i u pisanom obliku.Iznimno pisanim putem može se isključiti primjena Općih uvjeta na pojediniugovorni odnosu,odnosno odstupiti od pojedinih odredbi Općih uvjeta.

Opći uvjeti čine sastavni dio svakog ugovora s Korisnikom te ga nadopunjuju. U slučaju da odredbe pojedinačnog pisanog ugovora odstupaju od odredaba Općih uvjeta, prednost imaju odredbe pojedinačnog pisanog ugovora. Isključuje se valjanost bilo kakvih ranijih usmenih dogovora.Za slučaj da Korisnik ima opće uvjete poslovanja koji odstupaju od ovih Općih uvjeta, ugovorne strane suglasno pristaju na primjenu ovih Općih uvjeta, ako drukčije nije ugovoreno.

Pružatelj usluga zadržava pravo u svako vrijeme bez prethodno najave izmijenitiOpće uvjete, opseg i sadržaj usluga kao i izgled i funkcionalnost mrežnih stranica i drugih podataka vezan uz web stranicu, s tim da se eventualne izmjene Općih uvjeta primjenjuju isključivo na ugovore sklopljene nakon stupanja na snagu izmijenjenih Općih uvjeta i njihove objave na web stranicama Pružatelja usluga.

Članak 4.

Ovi Opći uvjeti poslovanja predstavljaju i predugovornu obavijest, te se odnose na sklapanje ugovora o najmu ukoliko je Korisnik potrošač odnosno svaka fizička osoba koja sklapa pravni posao ili djeluje na tržištu izvan svoje trgovačke, poslovne, obrtničke ili profesionalne djelatnosti, te ukoliko potrošač sklapa ugovor izvan poslovnih prostorija Pružatelja usluga odnosno ugovor na daljinu.

Ovi Opći uvjeti se odnose i na ugovor o najmu i primjenjuju i na pravne osobe kao i fizički osobe koje djeluju u okviru svoje trgovačke, poslovne, obrtničke ili profesionalne djelatnosti, uz iznimke navedene ovim Općim uvjetima.

Članak 5.

Ovi Opći uvjeti bit će objavljeni na web stranici Pružatelja usluga:www.kiddieonboard.hr

Pristup na internetske stranice Pružatelja uslugaponekad može biti nedostupan zbog radova, održavanja ili uvođenja novih sadržaja, te u slučajevima nepredviđenih okolnosti koje su izvan kontrole Pružatelja usluga, koje će isti nastojati otkloniti u najkraćem mogućem roku.

  1. PREDMET PRODAJE

Članak 6.

Pružatelj usluga jetrgovačko društvospecijalizirano prvenstveno za pružanje usluge iznajmljivanje i davanje u najampredmeta za osobnu uporabu i kućanstvo.Predmet najma bit će opisan na web stranici Pružatelja usluga ili će biti određen na neki drugi način u pisanom obliku, te se predmeti najma može mijenjati samo pisanim sporazumom.

Članak 7.

Predmet narudžbe mogu biti samo proizvodi za koje je u narudžbi naznačeno da su raspoloživi i dostupni. Zbog većeg broja narudžbi koje se istovremeno predaju na web stranici Pružatelja usluga, može se dogoditi da informacija o raspoloživosti proizvoda ne bude istovjetna sa stanjem u skladištu stoga Pružatelj usluga ne jamči dostupnost naručenih proizvoda sve dok ne potvrdi narudžbu

Ukoliko naručeni proizvodnije raspoloživ na skladištu ili dostupan na drugi način, Pružatelj uslugamože obavijestiti Korisnika da:(i) proizvodtrenutno nije raspoloživ, odnosno dostupan, (ii) o roku u kojem je proizvod raspoloživ, (iii) dogovoriti novi rok isporuke po potrebi, te (iv) ujedno ponuditi mogućnost najma alternativnog proizvoda koji je raspoloživ za isporukui koji je po svojim karakteristikama najbliži proizvodu koji nije moguće isporučiti.

Članak 8.

Fotografije proizvoda iz asortimana Pružatelja usluga na web stranici su ilustrativne prirode, te ne moraju uvijek i u svim detaljima odgovarati proizvodima koji su predmet narudžbe (npr. boja). Vizualni identitet proizvoda prikazan na fotografiji ne mora odgovarati izgledu proizvoda u stvarnosti, a i s obzirom na postavke monitora na računalu Korisnika i sl.U slučaju gore navedenog nesklada između proizvoda prikazanog na fotografiji i isporučenog proizvoda ne radi se o nedostatku proizvoda.

Podaci o proizvodima (opis proizvoda i/ili usluge, cijena i dr.) prikazani na web stranici Pružatelja usluga podložni su „bugovima“, nepravilnostima u radu aplikacije i/ili web stranice, drugim tehničkim nepravilnostima, tipografskim pogreškama i sl. U slučaju očitih pogrešaka ili neispravnosti u pogledu podataka o proizvodima prikazanih na web straniciPružatelja usluga isti zadržava pravo jednostrano raskinuti ugovor.

  1. ZASNIVANJE UGOVORNOG ODNOSA

Članak 9.

Ugovorni odnos između Pružatelja usluga i Korisnikanastaje prihvatom ponude (neovisno o tome da li su stranke sklopileugovor u pisanom obliku ili je poslovna suradnja zasnovana temeljem ponude i narudžbenice ili nadrugi pisani način), neovisno o tome kada je proizvod predan u posjed Korisniku.

Korisnik prihvaća primjenu ovih Općih uvjeta te je suglasan da isti budu primarno mjerodavni za tumačenje volje ugovornih strana.U slučaju bilo kakve nedosljednosti između pisane ponude i Općih uvjeta, prednost će imati Opći uvjeti, ukoliko u pisanom obliku ne bude drukčije dogovoreno.

Članak 10.

Neobvezujuće ponude Pružatelja usluga smatraju se pozivom Korisnika da pod tim uvjetima podnese narudžbu Pružatelju usluga (ponudu za najam). Tek kada Pružatelj usluga pisanim putem prihvati / potvrdi takvu narudžbu Korisnika, nastaje obveza za pružatelja usluga.

Članak 11.

Osim ako drugačije nije izričito pisano ugovoreno, Korisnik (koji ima status potrošača u smislu Zakona o zaštiti potrošača – dalje: ZZP) narudžbom / ponudom koju upućuje Pružatelju usluga izričito izjavljuje zahtjev da izvršenje ugovorene usluge (za koju potrošač ugovorom preuzima obvezu plaćanja) započne prije isteka roka za jednostrani raskid ugovora iz članka 79. ZZP-a.

Korisnik potvrđuje da je upoznat da gubi pravo na jednostrani raskid ugovora iz članka 79. ZZP-aako usluga bude ispunjena u potpunosti te da će u slučaju jednostranog raskida ugovora biti dužan platiti Pružatelju usluga razumni dio cijene sukladno članku 84. stavku 8. ZZP-a.

  1. CIJENE i PLAĆANJE

Članak 12.

Pružatelj usluga uređuje cijenu najma proizvoda iz svog asortimana posebnim cjenikom koji je podložan izmjenama, a koji može biti istaknut u ponudama, cjenicima, web-stranicii drugim materijalima.Cijene suizražene u eurima, a predstavljaju neto cijenuuvećanu za trošak PDV-a u visini od 25% po stopi propisanoj Zakonom o porezu na dodanu vrijednost (Narodne novine broj: 3/2013 i dr.) u vrijeme isporuke proizvoda. Cijena ne obuhvaća sporedne troškove (troškovi dostave, ambalaže i sl.) koji se zasebno zaračunavaju Korisniku i koji mogu biti istaknuti u ponudama, cjenicima, web-stranici i drugim materijalima.

Članak 13.

Po prihvatu ponude Pružatelj usluge stavlja rezervaciju na proizvod koji je predmet ugovora te  ukupna naknada za najam dospijeva i plaća se odmah po izvršenoj narudžbi.

Način plaćanja:

Pružatelj usluga omogućuje plaćanje:

  • Kartično plaćanje:
    • Obročno do 24 rate:Visa Premium kreditnom karticom do 24 rate bez kamata
    • Jednokratno: Visa Premium, Visa, MasterCard
  • Općom uplatnicom ili Internet bankarstvom (kod izbora ovog načina plaćanja Korisnik će na e-mail adresu dobiti predračun sa podacima potrebnima za uplatu. Po zaprimljenoj uplati, Pružatelj usluga će Korisniku poslatinaručene proizvode.)
  •  

Članak 14.

U slučaju zakašnjenja s plaćanjem Pružatelj usluga će obračunati Korisniku zatezne kamate sukladno primjenjivim zakonskim propisima.

  1. ISPORUKA I PREUZIMANJE PROIZVODA

Članak 15.

Pružatelj usluga omogućava isporuku proizvoda:

  • Preuzimanje proizvoda u skladištu društva Pružatelja usluga,
  • Dostava proizvoda na adresu Korisnika.

Članak 16.

U slučaju izbora osobnog preuzimanja proizvoda iz skladišta, Korisnik dužan proizvod preuzeti sa skladišta uugovorenom roku. Ako Korisnik ne preuzme proizvod u ugovorenom roku dužan je neovisno o navedenom plaćati najamninu od ugovorenog roka – početka najma.

Članak 17.

Pružatelj uslugamože odrediti vrstu transporta i prijevoznikaza isporuku proizvoda. Dostava se može vršiti putem dostavne službe, odnosno prijevozničkih tvrtki koje obavljaju usluge transporta ili osobno od strane ovlaštene osobe Pružatelja usluga.

Dostava proizvoda na adresu Korisnika je ograničena na područje od oko 40 km od Zračne luke Split što obuhvaća sljedeće gradove/općine i njihovu bližu okolicu: Omiš, Dugi Rat, Podstrana, Stobreč, Split, Solin, Klis, Dugopolje, Kaštela, Trogir, Marina, Rogoznica, Primošten te otoke: Brač, Hvar, Šolta, Vis, Korčula, Veli Drvenik, Mali Drvenik; a iznimno, prema dogovoru, i na druge lokacije. Dostava na adresu vrši se do ulaza u objekt na adresi. Ukoliko se radi o stambenoj zgradi, dostavljač nije dužan nositi proizvod do kata na kojem se nalazi Korisnik već do ulaza u zgradu.

Dostava proizvoda koja se nalazi na skladištu naručena za idući dan vrši se sljedećeg dana (računajući samo radne dane). Dostava proizvoda čija narudžba je zaprimljena u petak vrši se sljedeći radni dan, tj. ponedjeljak. Hitna dostava proizvoda s kraćim rokom dostave od ranije specificiranog iznimno je moguća i plaća se prema dogovoru s Pružateljem usluge.

U slučaju kada dostava nije moguća u ugovorenom rokuzbog više sile ili drugih smetnji izvan kontrole Pružatelja usluge, Korisnik će o tome biti pravovremeno obavješten. U tom slučaju automatski se produžuju rokovi isporuke i to za razdoblje trajanja događaja više sile ili druge smetnje izvan kontrole Pružatelja usluga.

U slučaju da Korisnik izabere dostavu na svoju kućnu adresuistom će na e-mail adresu naznačenu tijekom narudžbe biti upućenekonkretne i detaljne informacije o dostavi.

Trošak dostave se određuje cjenikom. Troškove dostave u cijelosti plaća Korisnik.

Članak 18.

U slučaju osobne dostave (preuzimanje na skladištu ili dostava od strane ovlaštene osobe Pružatelja usluga) proizvod može biti uručen bez ambalaže, samo s Uputama, ili s ambalažom koju čini čini nepromočiva plastična vreća ili torba u kojoj se, osim proizvoda, nalaze i Upute o korištenju za svaki pojedini proizvod; a u slučaju dostave dostavnom službom i kartonska kutija.

Članak 19.

Korisnik je dužan proizvod preuzeti od strane dostavne službe.

U slučaju da dostava proizvoda na adresu Korisnika nije realizirana zbog razloga na strani Korisnika (pogrešan unos podataka koji se tiču: e-mail adrese, kontakt broj, adrese preuzimanja i sl.) ili ukoliko Korisnik bez opravdanog razloga nije preuzeo poslane proizvode te se oni vratePružatelju usluga (npr. s naznakom „obaviješten nije podigao“), Pružatelj usluge će ponovno uputiti proizvod na dostavu Korisniku.

 

U slučaju iz stavka 2. ovog članka, Pružatelj usluga zadržava pravo naplate dodatnihtroškova dostave od Korisnika koji su nastali.

Ako Korisnik ne preuzme proizvod u ugovorenom roku dužan je neovisno o navedenom plaćati najamninu od dana kada dostava nije realizirana zbog razloga na strani Korisnika.

Prijelaz rizika i odgovornost za materijalne nedostatke

Članak 20.

Svi rizici vezani uz proizvode te isporuku prelaze na Korisnika u trenutku predaje proizvoda Korisniku

Članak 21.

O eventualnim nedostajućim količinama proizvoda ili pogrešno isporučenomproizvodu, Korisnik je dužan obavijestiti Pružatelja uslugau pisanom obliku bez odgode, a najkasnije u roku od 24 sata od dana primitka proizvoda koji se dostavlja putem dostavne službe, uz navođenje točnih podataka o nedostacima količine odnosno krivo isporučenom proizvodu te fotografija nedostataka/neprikladnosti inače gubi pravo koje mu po toj osnovi pripada.

Ako se proizvod preuzima u skladištu Pružatelja usluga ili je dostavljen od strane ovlaštene osobe Pružatelja usluga, Korisnik je proizvod dužan pregledati na licu mjesta.

Članak 22.

Korisnik koji nema svojstvo potrošača je dužan primljeniproizvod na uobičajeni način pregledati odmah prilikom njenog preuzimanja ili je dati na pregled, čim je to prema redovitom tijeku stvari moguće te o vidljivim nedostacima obavijestiti Pružatelja usluga bez odgađanja, inače gubi pravo koje mu po toj osnovi pripada.

  1. OPĆE ODREDBE O NAJMU

Članak 23.

Pružatelj usluga obvezuje se dostaviti / staviti na raspolaganje ispravne, čiste i dezinficirane proizvode.

Korisnik je dužan s unajmljenim proizvodimapostupati s pažnjom dobrog gospodarstvenika te u skladu s uputama za korištenje koju mu je Pružatelj usluga stavio na raspolaganje te odgovora za štetu nastalu gubitkom, oštećenjem i/ili krađom/nestankom unajmljenih proizvoda.  

Korisnik nije ovlašten koristiti proizvode protivno namjeni. Tijekom uporabe proizvoda Korisnik mora osigurati da proizvodi nisu korišteni u neadekvatnim uvjetima. Korisnik ne smije vršiti nikakve modifikacije, popravke ili bilo kakve druge zahvate na unajmljenim proizvodima.

Korisnik nije ovlašten davati unajmljene proizvode trećima osoba u podnajam bez prethodne pisane suglasnosti Pružatelja usluga.

Korisnik je odgovoran za sve štete nastale na proizvodima zbog nepridržavanja gore navedenih uvjeta.

Trajanje najma, povrat proizvoda, odgovornost za štetu i naplata štete.

Članak 24.

Najam počinje danom kada Korisnik preuzme proizvod (osobno ili putem ovlaštene osobe) u skladištuili kada proizvod preuzme (osobno ili putem ovlaštene osobe) od strane dostavne službe ili Pružatelja usluga, a završava danom povrata u isto skladište ili danom predaje proizvoda dostavnoj službi ili osobi koju je ovlastio Pružatelj usluga. Ugovoreno trajanje najma može se produljiti jedino izričito uz prethodnu suglasnost Pružatelja usluga uz obvezu da ga je Korisnik prethodno pisano obavijestio najkasnije 2 dana prije isteka najma.

Iznimno od stavka 1. ovog članka, najam počinje s danomkada je isti ugovoren a proizvod ne bude preuzet od strane Korisnika njegovom krivnjom.

Članak 25.

Korisnik može slobodno odabrati način povrata unajmljenih proizvoda. Korisnik može unajmljeneproizvode vratiti:

  1. predajom na skladište Pružatelja usluga (osobno ili putem ovlaštene osobe),
  2. dostavom putem dostavne službe,
  3. predajom izravno ovlaštenoj osobi Pružatelju usluga na adresi Korisnika.

Članak 26.

U slučaju povrata proizvoda izravnom predajom na skladište Pružatelja usluga ili predajom ovlaštenoj osobi Pružatelja usluga na adresi Korisnika tada proizvod mora biti predan do 20,00 sati zadnjeg dana najma, a u slučaju povrata proizvoda putem dostavne službe tada proizvod mora biti predan dostavnoj službi u vrijeme kada dostavna služba najavi dolazak tijekom zadnjeg dana najma.

Korisnik je dužan Pružatelju usluge najkasnije do 9:00 sati prethodnog dana predložiti promjenu načina povrata proizvoda.

Članak 27.

Korisnik je obvezan vratiti unajmljene proizvode u prvobitnom stanju u potpunosti operativnu, čistu i bez oštećenja koja prelaze redovno korištenje.Proizvodi se vraćaju u istoj ambalaži u kojoj su isporučeni osim u slučaju ako po prirodi stvari to ne bi bilo moguće stoga se Korisniku preporuča sačuvati ambalažu u kojoj je preuzeo naručeneproizvode.

Članak 28.

Nakon povrata proizvoda Pružatelj usluga će istu pregledati, definirati eventualno nastala oštećenja, onečišćenja,kvarove i ostale nedostatke te o njima bez odgodepisano obavijestiti Korisnika.

Članak 29.

Za sve vraćene proizvode kojisu tijekom trajanja najmaoštećenii/ili zaprljani bilo od strane Korisnika bilo od strane treće osobe kojoj je Korisnik predao unajmljeni proizvod, Korisnik je Pružatelju usluga obvezan platiti punu cijenu troškova popravka i/ili čišćenja.

Ukoliko popravak i/ili čišćenje nije mogućili ekonomski isplativ (totalna šteta) radi čega proizvod više nije podoban za korištenjeKorisnik je dužan platiti razliku između cijene najma i maloprodajne cijene proizvoda.

Članak 30.

Ukoliko Korisnik ne vrati unajmljeni proizvod u roku od 10 dana od isteka ugovorenog roka povrata tada će se proizvod smatrati izgubljenim/nestalimkrivnjom Korisnika te će Pružatelj uslugapored zakasninebiti ovlašten naplatiti Korisniku iznos maloprodajne cijene proizvoda.

 

Korisnik prihvaća kako Pružatelj usluge ne odgovara za propuste, pogreške, nedostatke, oštećenja i sl. koji nastanu za vrijeme, odnosno od strane dostavnih službi, zbog čega se odriče zahtjeva prema Pružatelju usluga koji su posljedica navedenih propusta dostavnih službi.

Zakasnina

Članak 31.

Ako Korisnik ne vrati iznajmljene proizvode u ugovorenom roku tada se Korisniku naplaćuje zakasnina u visini cijene po danu najma proizvoda za svaki dan kašnjenja uvećanoj za 50% ugovorenog iznosa.

Pravo na otkaz

Članak 32.

Sklopljen ugovor između Pružatelja usluge i Korisnika može se jednostrano otkazati od strane Korisnika, pri čemu se primjenjuju sljedeći uvjeti:

  1. a) ako je otkaz Korisnika uručen do 7 dana prije ugovorenog prvog dana najma – Pružatelj usluge vraća ukupan iznos najamnine;
  2. b) ako je otkaz Korisnika uručen od 7. do 3. dana prije ugovorenog prvog dana najma – Pružatelj usluge vraća 50% iznosa od ukupnog iznosa najamnine;
  3. c) ako je otkaz Korisnika uručen unutar 3 dana do dana ugovorenog prvog dana najma – nema povrata najamnine.

Korisnik u slučaju otkaza iz stavka 1. ovog članka ima pravo na povrat troškova dostave, pod uvjetom da proizvod do trenutka otkaza nije upućen na dostavu Korisniku.

Jednostrani otkaz Korisnika iz ovog članka se upućuje pisanim putem i to e-mailom Pružatelju usluge, na podatke iz  zaglavlja ovih Uvjeta.

  1. ZAŠTITA POTROŠAČA

Članak 33.

Odredbe članaka glave 7. i 8. Općih uvjeta (članci 37. do 47.) primjenjuju se isključivo na ugovorne odnose koji nastaju sklapanjem ugovora o najmu između Pružatelja usluga i Korisnika koji ima svojstvo potrošača, odnosno fizičke osobe koja kao potrošač s Pružateljem usluga sklapa pravni posao izvan svoje trgovačke, poslovne, obrtničke ili profesionalne djelatnosti u skladu s odredbama ZZP-a.

Ugovor o najmu kojeg sklapaju Pružatelj usluga i Korisnik smatra se u kontekstu ZZP ugovor o usluzi, odnosno ugovor kojim Pružatelj usluga pruža ili se obvezuje pružiti uslugu potrošaču, a potrošač plaća ili se obvezuje platiti Pružatelju usluga cijenu.

PRAVO NA JEDNOSTRANI RASKID UGOVORA

Članak 34.

Korisnik- potrošač ima pravo bez navođenja razloga u roku od četrnaest dana od sklapanja ugovora o najmuproizvoda izjaviti jednostrani raskid ugovora sklopljenog na daljinu odnosno odustati od svoje narudžbe učinjene putem web stranice. Ovo pravo Korisnik – potrošač ima isključivo u slučajevima predviđenim ZZP-om.Rok za jednostrani raskid ugovora počinje teći od dana sklapanja ugovora.

Primjerak obrasca o jednostranom raskida ugovora je sljedeći:

Članak 35.

Da bi Korisnik mogao ostvariti pravo na jednostrani raskid ugovora, mora obavijestiti Pružatelja usluga o svojoj odluci prije isteka roka i to nedvosmislenom izjavom poslanom poštom, ili elektroničkom poštom, u kojoj će navesti svoje ime i prezime, adresu, broj telefona, ili adresu elektroničke pošte, a može koristiti i priloženi primjer obrasca za jednostrani raskid ugovora.

Članak 36.

Korisnik – Potrošač nema pravo na jednostrani raskid ugovora ukoliko je u potpunosti ispunjen ugovor o uslugama za koji je Korisnik kao potrošač preuzeo obvezu platiti cijenu, a ispunjenje je započelo uz izričit prethodni pristanak Korisnika – potrošača te uz njegovu potvrdu da je upoznat s činjenicom da će izgubiti pravo na jednostrani raskid ugovora ako usluga bude u potpunosti ispunjena.

Članak 37.

Iskoristi li potrošač svoje pravo na jednostrani raskid ugovora strane nisu dužne ispuniti svoje obveze iz ugovora sklopljenog izvan poslovnih prostorija i ugovora sklopljenog na daljinu te je je svaka strana dužna vratiti drugoj ono što je primila na temelju ugovora.Potrošač nije dužan naknaditi troškove koji su bili posljedica korištenja njegova prava na jednostrani raskid ugovora, osim onih predviđenih člankom 83. stavkom 2. i člankom 84. ZZP-a.

Članak 38.

Ako Korisnik jednostrano raskine ugovor bez primitka, odnosno preuzimanja naručene proizvoda, Pružatelj usluga izvršit će povrat novca, bez odgađanja, a najkasnije u roku od 14 dana od dana zaprimanjaodluke o jednostranom raskidu ugovora.Povrat novca bit će izvršen na isti način na koji je Korisnik izvršio uplatu.

Članak 39.

Uslučaju da je Korisnik jednostrano raskinuo ugovor nakon primitka proizvoda tada Pružatelj usluga mora izvršiti povrat plaćenog tek nakon što mu proizvod bude vraćen odnosno nakon što mu potrošač dostavi dokaz da je proizvod poslao natrag.

U slučaju jednostranog raskida ugovora Korisnik je obvezan vratiti proizvodePružatelju usluga bez nepotrebnog odgađanja.

Pružatelj usluga nije u obvezi izvršiti povrat dodatnih troškova koji su rezultat potrošačeva izričitog izbora vrste prijevoza koji je različit od najjeftinije vrste standardnog prijevoza koji je ponudio Pružatelj usluga.

U razdoblju u kojem Korisnik – potrošač ostvaruje pravo raskida ugovora mora čuvatiproizvod s dužnom pažnjom odnosno mora se ponašati kao osobito pažljiv i savjestan čovjek. U slučaju umanjenja vrijednosti proizvoda koje je rezultat rukovanja proizvodom od strane Korisnika tada Pružatelj usluga ima pravo naplatiti štetu iz iznosa primljene cijene u omjeru umanjenja vrijednosti proizvoda premavlastitoj procijeni uzimajući u obzir objektivne kriterije svakog pojedinog slučaja.

Članak 40.

Ako Korisnik – Potrošač jednostrano raskine ugovor nakon što je izričito zahtijevao da pružanje usluge započne prije isteka roka za jednostrani raskid ugovora tada je Korisnik – potrošač dužan platiti Pružatelju usluge dio ugovorene cijene koji je razmjeran onome što je Pružatelj usluga ispunio Korisniku potrošaču do trenutka kada ga je potrošač obavijestio o tome da koristi svoje pravo na jednostrani raskid ugovora, s tim da se proporcionalni iznos cijene koji je Korisnik – potrošač dužan platiti izračunava na temelju ukupne ugovorene cijene.

Članak 41.

Potrošač je odgovoran za svako umanjenje vrijednosti proizvoda koje je rezultat rukovanja proizvodom, osim onog koje je bilo potrebno za utvrđivanje prirode, obilježja i funkcionalnosti proizvoda.

 

  1. OBAVIJEST O NAČINU PISANOG PRIGOVORA POTROŠAČA

Članak 42.

Eventualne žalbe i prigovori na račun ili uslugu, Korisnik je dužan dostaviti Pružatelju usluga najkasnije u roku od 8 dana od pružanja usluge. Ako na taj način Korisnik pravovremeno ne ospori pruženu uslugu, smatra se da Korisnik nema prigovora na pruženu uslugu te da je s istom suglasan.

Članak 43.

Sve prigovore sukladno članku 10. ZZP, potrošač može poslati putem pošte na adresu Pružatelja usluga:Ulica Nikole Zrinskoga 7, 21217 Kaštel Novi, adresu elektroničke pošte info@kiddieonboard.hr ili osobno u poslovnim prostorijama Pružatelja usluga na adresi Ulica Nikole Zrinskoga 7, 21217 Kaštel Novi.

Članak 44.

Kako bi Pružatelj usluga odgovorio potrošačuna pisani prigovor koji nije upućen elektroničkom poštom, mole se potrošači da navedu točne podatke o svome imenu i prezimenu te adresi na koju će im biti dostavljen odgovor. Odgovor na prigovor potrošača Pružatelj usluga zakonski mora dati u pisanom obliku najkasnije u roku 15 dana od dana primitka prigovora.

 

  1. PRESTANAK UGOVORA I OTKAZ UGOVORA

Članak 45.

Ugovor o najmu prestaje urednim ispunjenjem obveza ugovornih strana.

Članak 46.

Pružatelj usluga može raskinuti Ugovor o najmu u slučaju da Korisnik krši odredbe sklopljenog Ugovora i/ili odredbe Općih uvjeta.

Ugovor se otkazuje pisanimputem, putem e-maila naznačenih u ovome Ugovoru ili slanjem preporučene poštanske pošiljke na adresusjedišta Pružatelja usluga.Ukoliko Korisnik odbije primitak otkaza, smatra se da je otkaz uručen s danom predaje otkaza na poštu.

U tom slučaju Pružatelj usluga ima pravo odmah i bez ikakvog ograničenja preuzeti proizvode koji je bio u najmukod Korisnika ili ju je Korisnik dužan predati / dostaviti u roku od 3 dana od primitka obavijesti o otkazu ugovora.

Korisnik će u svakom slučaju moratiPružatelju usluga platiti najamninu, te sva druga potraživanja koja proizlaze iz ugovora, kao i nadoknaditi Pružatelju usluga svetroškove prijevoza kao i druge troškove koji nastanu.

Članak 47.

Ako Korisnik i nakon pisane opomene Pružatelja usluga rabi stvar protivno ugovoru ili njezinoj namjeni, zanemaruje njezino održavanje, oštećuje stvar, osobito ako neovlašteno prepušta trećemu uporabu stvari, Pružatelj usluga može otkazati ugovor bez pridržavanja otkaznog roka.

 

VIŠA SILA I PROMIJENJENE OKOLNOSTI

Članak 48.

Ugovorne strane će biti oslobođene odgovornosti za djelomično ili potpuno neispunjenje obveza iz Ugovora ukoliko je isto prouzrokovano okolnostima izvan njihove kontrole koje su nastale nakon sklapanja ugovora, koje se u vrijeme sklapanja ugovora nisu mogli predvidjeti, niti su ih ugovorne strane mogle spriječiti, izbjeći ili otkloniti, kao što su npr. požari, potresi, poplave kao i štrajkovi, ratovi ili vojne operacije.

Ako je u tom slučaju jedna ugovorna strana ispunila svoju obveze, može zahtijevati vraćanje po pravilima o vraćanju stečenog bez osnove.

Članak 49.

Ako bi zbog izvanrednih okolnosti nastalih nakon sklapanja ugovora, a koje se nisu mogle predvidjeti u vrijeme sklapanja ugovora, ispunjenje obveze za Pružatelja usluga postalo pretjerano otežano ili bi mu nanijelo pretjerano veliki gubitak, on može zahtijevati da se ugovor izmijeni ili čak i raskine.

  1. INTELEKTUALNO VLASNIŠTVO

Članak 50.

Sadržaj kataloga i webshop Internet trgovine Pružatelja usluga zaštićen je i Pružatelj usluga ostvaruje jedinstveno pravo na njegovo korištenje. Za svako komercijalno korištenje sadržaja na web stranicama Pružatelja uslugapotrebno je prethodno kontaktirati Pružatelja usluga putem e-mail info@kiddieonboard.hr

  1. PRIJELAZNE I ZAVRŠNE ODREDBE

 

Članak 51.

Za slučaj spora iz ili u svezi sa zaključenim ugovorom, stranke će isti nastojati riješiti mirnim putem. U slučaju nepostizanja mirnog rješenja spora, stranke ugovaraju nadležnost suda u Zagrebu, s time daPružatelj uslugamože pokrenuti postupak i pred sudom opće mjesne nadležnosti za Korisnika.

Članak 52.

Ako bilo koji dio iz Općih uvjeta postane nevaljan, nezakonit ili neizvršiv na bilo koji način, ostatak ugovora i Općih uvjeta ostaju na snazi.

Članak 53.

Za ugovore koje Pružatelj usluga zaključi u obavljanju svoje djelatnosti mjerodavno je pravo Republike Hrvatske.

U slučaju razlike između hrvatske i engleske verzije ovih Uvjeta, primjenjuje se hrvatska verzija.

Članak 54.

Opći uvjeti poslovanja stupaju na snagu dana 20.5.2024. godine te su dostupni i na internetskoj stranici društva KIDDIE ON BOARD d.o.o. koja glasi:www.kiddieonboard.hr
